DUI & Traffic Defense
Bad days don’t get any worse. If you have been charged with a DUI or Traffic Violation in Georgia, then you need an experienced lawyer.
Life can change pretty quickly. In a matter of moments, you can go from heading home after a night on the town or dinner with friends to being stopped at a checkpoint or being pulled over by the police for suspicion of “drunk” or “impaired driving.” The shock and intimidation of being arrested for a DUI in Georgia are unimaginable. Nothing compares to the threat of having your freedom, job, and personal relationships taken away from you.
If you have any alcohol on your breath, you will be asked to step out of your car and perform “field sobriety tests.” If you try to perform these tests, you will likely fail and be arrested. If you refuse, you will absolutely be arrested. Either way, you are going to spend the night in jail and will need to consult an experienced DUI lawyer right away.
One of the most important things you can do after being arrested for a DUI in Georgia is to find out as much information as possible about your legal rights and options.
What You Need to Know about Georgia’s Law:
If you are charged with a DUI in the State of Georgia, you should know that it has recently cracked down on DUI laws. One of these laws you must know is the 10-Day Rule.
Whether you refused to take a blood, breath or urine test or you took one of these tests and your result is 0.08 or greater, you have only
10 days to request a special hearing. If you do not do this, your driver’s license can be suspended for one year.
Please read the following important facts. If any of them are in your DUI arrest, the 10-Day Rule applies to you:
- You took one of the three tests and your blood alcohol content was over the legal limit of 0.08
- You refused to take any of the three tests
- You tried to take the tests, but the police officers stated that you “refused”
- You were under 21 on the day of the arrest and your test result was .02 or higher
- You had a CDL in your truck when arrested and your blood alcohol level was .04 or higher
- You are not even sure what your blood alcohol level was
The DS-1205 Form is Your Temporary License, so KEEP IT WITH YOU.
Some arrested drivers refuse to sign the DS-1205 Form. They insist on speaking to an attorney first or are just mad at their general
predicament. Georgia’s highest court has ruled that you do not have the right to ask an attorney for advice before either submitting to official
implied consent testing or refusing to be tested. This failure to sign the Form DS-1205 accomplishes nothing and possibly could mean that you
have no temporary right to drive if you refuse to sign the Form DS-1205. We can help cure that problem by filing an immediate appeal of the
pending suspension.
Contracts
A contract is a legally binding agreement between parties to do or not do something. Consumers and businesses enter into contracts on a daily basis, whether buying a house, taking out an insurance policy or making a routine purchase for certain goods or services. It is important that before entering into a contract, a person fully understands the terms of the contract that will bind the parties. Most contract disputes occur because of a misunderstanding between the parties or a failure to communicate. If you do not understand the terms of a contract, it is best to consult an attorney before signing the contract or otherwise engaging in performance relative thereto. The Law Offices of A. J. Mitchell can assist you with all aspects of contract law including contract litigation and the formation and negotiation of the following documents:
⦁ Business contracts and subcontracts
⦁ Employment contracts
⦁ Independent contractor agreements
⦁ Construction contracts
⦁ Purchase and sale agreements
⦁ Promissory notes
⦁ Deeds of trust/security deeds
⦁ Asset purchase agreements
⦁ Shareholder agreements
⦁ Operating agreements
⦁ Joint venture agreements
